PLEASE READ BEFORE PURCHASING PRODUCTS

Definitions “Purchaser” means the person, firm or corporation to whom the sales order is issued;

‘The Institute Of Wow’ means ‘The Institute Of Wow Pty Ltd’ ABN 84 155 355 135

“Sales Order” means the agreement between ‘The Institute Of Wow’ and the Purchaser incorporating the general terms and conditions, and all applicable documents thereto;

“Date of Delivery” means the date upon which the products are dispatched from ‘The Institute Of Wow’ Premises to the Purchaser;

“Date of Cancellation” means the date upon which ‘The Institute Of Wow’ receives notice of cancellation from the Purchaser;

“Early Termination Fee" means the fee payable for early termination of any 12 month minimum ongoing package. If cancelled in months 1 to 6, this amount is $750. If cancelled in months 6 to 12 this amount is $500; In the case of the Business Boost Program, should the purchaser wish to cancel after they have had their half day workshop they will be required to pay an early termination fee of$1,500.

Privacy Policy

1.    This policy sets out how ‘The Institute Of Wow Pty Ltd’ collects, uses and discloses your personal information. By purchasing ‘The Institute Of Wow’ products, you agree to the use and disclosure of your personal information in the manner described in this policy. Words defined in ‘The Institute Of Wow’ Terms and Conditions of Use have the same meaning in this Privacy Policy. ‘The Institute Of Wow Pty Ltd’ is bound by the Privacy Act (1988).‘The Institute Of Wow’ collects personal information that it considers necessary, to provide the range of services they offer.

2.    Personal information collected by ‘Institute Of Wow’ may include:



a) your name, address and contact details

b) credit account details

c) user ID's and passwords

d) the services provided to you 


3. ‘The Institute Of Wow’ collects personal information in a number of ways, including;

    a)   directly from you when you provide information directly to ‘The Institute Of Wow’ in person,

 phone or in writing (whether electronic or otherwise)

b) directly from you when you communicate with ‘The Institute Of Wow’ or any other person using   ‘The Institute Of Wow’ Communications Services. 


4. Your personal Information may used for the following purposes:

a) to provide the services requested by you

b) to manage those services including, customer service and billing

c) to research, develop and improve ‘The Institute Of Wow’ services

d) to conduct surveys to determine use and satisfaction with ‘The Institute Of Wow’ services

e) to generate statistics in relation to ‘The Institute Of Wow’ Network

f) to promote and market special offers and other services to you.

‘The Institute Of Wow’ does not disclose personal information to any individuals and organizations without the prior consent of the individual.

You have a right to access your personal Information.

If you choose not to provide personal information when requested, ‘The Institute Of Wow’ may not be able to provide you with the full range of ‘The Institute Of Wow’ services.


The Institute Of Wow’ takes reasonable steps to protect personal information collected from misuse, loss, unauthorized access, modifications or disclosure.


If you receive any mailing material from us then it will be as a result of your email address being listed with us for the purpose of receiving information, previously purchased or expressed interest in our products, services, seminars or events.

Each email from us contains an easy to understand link which you may click if you wish to unsubscribe.

 

 Entire Agreement

     I.       The sales order is the only document which will be recognised by ‘The Institute Of Wow’ as authority to undertake the services.

   II.       The sales order constitutes the entire agreement between the parties and supersedes all previous negotiations, and communications.

  III.       The results of our programs may vary and are based on the purchaser’s individual capacity and business experience. There are no guarantees concerning the level of success the purchaser may experience.

 IV.       The use of ‘The Institute Of Wow’s information and products should be based on the purchaser’s own due diligence and ‘The Institute Of Wow’ is not liable for any success or failure of the purchaser’s business that is directly or indirectly related to the purchase of our products and services.

 

Cancellation and Refund Policy

1.    Business Booster Program – If you are not completely satisfied with the Business Booster Program, let us know within 30 days and you will receive a full refund. However, the purchaser will be required to pay the Early Termination Fee above if they have already received their half day workshop with John Dwyer.

2.    Imagineers Club Program - ‘The Institute Of Wow’ will provide the services described under the Imagineers Club Program for a period of 12 months (Term), and the Purchaser agrees to acquire these services for the entire Term. Note: This is a 12 (twelve) month program that may be paid off in monthly instalments. The Purchaser may cancel the Imagineers Club Program during the Term but will be required to pay an Early Termination Fee as set out in the definitions above.

After the end of the Term, ‘The Institute Of Wow’ will continue to provide Imagineers Club Program services to the Purchaser in accordance with these terms and conditions, until such time as the Purchaser cancels the sales order. After the Term, the Purchaser may cancel the Imagineers Club Program at any time, effective immediately.

3.    Monthly Membership site – There are no contracts entered into and members may discontinue their monthly membership at any time and have their membership terminated for not adhering to the terms and conditions. There are no contracts and no refunds. If a monthly member wishes to discontinue membership they may either email info@theinstituteofwow.com or click on the unsubscribe link at the bottom the membership emails.

 

Price

All the prices in the sales order, are expressed in Australian Dollars, and shall be determined by ‘The Institute Of Wow’ as follows;

1) Pursuant to the quoted priced payable per item, plus GST, if the price is not GST inclusive.

2) The Purchaser is liable for the amount of any GST payable in respect to the taxable supply.

    All Freight and charges shall be paid by the Purchaser.

 

Terms of Payment

Unless otherwise agreed, the services/packages under the sales order, must be paid in full prior to delivery. Tax Invoices are issued on the date services/products are dispatched. Payment via credit card, for packages (Business Booster Program, Imagineers Club Program and Membership Program) shall be deducted every 30 days from original date of purchase until cancelled.

Credit card transactions are processed in Australian Dollars. (AUD) All transactions will be processed securely by eway.com.au and no credit card details will be stored on ‘The Institute Of Wow’ site.

 

Default in Payment

‘The Institute Of Wow’ will treat any default by the Purchaser in payment of any monies due as a breach of the terms and conditions of the sales order. ‘The Institute Of Wow’ will then cease work on the relevant sales order and all other sales orders placed by the Purchaser. In the event that any amount due by the Purchaser to ‘The Institute Of Wow’ is dishonoured by payments being cancelled, withdrawn or being charged back to the card issuer, then the Purchaser shall remain liable for all charges and shall pay such an amount to ‘The Institute Of Wow’.

 

Delivery

All services/packages will be delivered within 14 working days upon receipt of payment. Delivery to regional areas is between 2 – 3 weeks upon receipt of payment.



 

SERVICES PROVIDED WITHIN THE PROGRAMS

Imagineers Club Program

Purchasers are entitled to a 3 hour exclusive workshop with John Dwyer, they may also bring up to 5 (five) staff members. Alternatively Purchasers are entitled to 2 x 90 minute Skype calls a fortnight apart. Purchasers are entitled to a Marketing Makeover Report within 30 (thirty) days of the workshop.

Purchasers are entitled to 6 x one hour phone consultations or Skype calls (one every two months) over the twelve (12) month period. Calls are not accumulative.

All email requests will be responded to within 7 working days. If copywriting or artwork is required John Dwyer will provide his valuable contacts in this regard, so that you can use the experts that he recommends.

Membership entitles the Purchaser to 2 tickets to 3 x Bootcamps over the twelve (12) month period.

Purchasers will also have exclusive access to John Dwyer’s Wow Ideas Library which consists of a multitude of marketing ideas, tips and commentary.
Purchasers will receive an electronic version of John Dwyer’s Marketing and Promotional contacts.

Purchasers are entitled to 12 x 1 hour Online Coaching Webinars over the twelve (12) month period.

(One webinar each month.)

What costs are not covered in the Imagineers Club?

Travel, accommodation and meals when attending the Bootcamps and other events involved in the program.

 

Business Booster Program – Purchasers are entitled to a ½ day (3 hour) Conference on the Gold Coast with John Dwyer (also includes up to 5 staff).  They will also receive minutes from the Conference and a Marketing Recommendation Report. Purchasers will also receive 2 x 30 min Coaching calls. These calls will take place in the second and third month of the program.

Purchasers will receive an electronic version of John Dwyer’s Marketing and Promotional contacts.

Purchasers are entitled to 12 x 1 hour Online Coaching Webinars over the twelve (12) month period. (One webinar each month.)

 

Digital Products -While every effort is made to provide an uninterrupted service ‘The Institute Of Wow’

will not be held liable for any downtime or disruption to third-party digital services used to deliver products. There is no Service Level Agreement express or implied. Digital products will be compatible with the most recent stable version of Web browsers, Video players, and PDF document readers available for Windows and Mac.

 

Competitions and events -

‘The Institute Of Wow’ acts only in an advisory capacity, and does not directly manage any promotions, competitions, events, prize draws, or any games of chance.

‘The Institute Of Wow’ will not be held liable or responsible for the outcome or result(s) of any promotions, competitions, events, prize draws, or any games of chance.

Any promotions, competitions, events, prize draws, or any games of chance are solely the responsibility of the company or individual(s) managing or promoting the event.

Intellectual Property –

Please note that all marketing ideas, layouts, scripts, recommendations and any other advice provided by ‘The Institute Of Wow’ remains the property of ‘The Institute Of Wow’ and can be used for promotional purposes by ‘The Institute Of Wow’ at anytime, both online and offline. Such ideas and marketing executions maybe included in JD’s Mega Swipe File and will be accessible to members of relevant Institute Of Wow programs or clubs. In other words, any advice from ‘The Institute Of Wow’, layouts or scripts provided by ‘The Institute Of Wow’ remains the intellectual property of ‘The Institute Of Wow’. Members have the right to use such advice, but the ownership of any ideas remains with ‘The Institute Of Wow’. A condition of membership is that any artwork or webpages that result from ‘The Institute Of Wow’ advice is able to be used in JD's Mega Swipe File for an infinite period of time.

Risk

All services/packages delivered shall be at the Purchaser’s risk. ‘The Institute Of Wow’ will not be liable for any damage or loss including consequential arising out of or in connection with the application of the services unless the damage or loss is a direct result of ‘The Institute Of Wow’ negligence or wilful default.
In any event, ‘The Institute Of Wow’s total liability (including any negligence) shall not exceed the cost of services/packages provided during the term of this agreement.
